In December, the Government approved a draft of a new Construction Act, which is to fundamentally change the organisation of the construction administration and the method of building permits. The law introduces a centralised system of state construction authorities and is based on the principle of “one authority – one procedure – one decision”. The aim is to eliminate the existing double-track processes and reduce the number of separate binding opinions of the authorities concerned.
At the same time, the proposal identifies the construction of mass housing and selected public buildings as being in the public interest, which should allow them to be permitted more quickly. It also envisages a reduction in the number of building authorities and the transfer of building officials to a new central structure of the state administration. According to the government, the new regulation should lead to a significant speeding up and clarification of the construction procedure and increase legal certainty for builders.
However, professional organisations, in particular ČKAIT, have been critical of the proposal and believe that the law does not solve all practical problems of construction proceedings. Criticism is directed, among other things, at the fact that the full digitisation of the construction agenda is to be de facto postponed until 2030. The proposal will now head to the Chamber of Deputies. The law is scheduled to come into general effect on 1 July 2026, with the new structure of construction authorities to be operational from the beginning of 2028.
