We often encounter the opinion that a contract of sale of movable property is such a trivial matter that it does not even need to be reviewed by a lawyer. However, especially for valuable items, complicated situations can arise which can be easily avoided by provisions incorporated in the contract.

Although he was acquainted with the buyer, he negotiated a reservation of title in the contract because he was to receive the purchase price in five instalments. Martin therefore rescinded the contract and demanded the return of the car and compensation for wear and tear caused by the buyer. Thanks to a properly drafted contract, he was entitled to everything and the agreed retention of title saved him “rounds” at the authorities for the transfer in the vehicle register.
Tip: Do you deal with contractual matters in cases where you, as the client, supply a substantial part of the material (e.g. fabric for a wedding dress) or where a substantial part of the performance consists in the performance of an activity (e.g. assembly, painting a flat)? Then go to the contract for work.
Car sellers often underestimate or completely neglect the transfer in the vehicle register. This puts them in a legally difficult situation where they can face fines, compensation claims and the impasse of not being able to transfer the car without physical possession.
Thus, before signing, it is essential to analyse all situations that could arise and include their performance in the contract.
