When an employer owes wages

You are legally and contractually entitled to wages for the work you do, but what should you do if your employer owes you wages for a long time? Is it possible to give immediate notice? Read all about it in this article.

15 days after wages are due

If your employer owes you wages or any part of them more than 15 days after they are due, you can quit immediately. However, this does not mean that you can give immediate notice if your employer is only a week late.

It is not the due date you have in your employment contract that is taken into account, but the 15 days after the end of the month. So for August, you must be paid by the end of September at the latest, then 15 days run before the employer has the opportunity to settle the amount. However, if this is not done by 16 October, you can terminate your employment immediately.

You must give your notice immediately in writing. If you give your notice in this way, you are still entitled to two average monthly salaries. This is the salary you would have received during the two-month notice period.

What if the employer still hasn’t paid the wages

In this case, the most ideal solution is to ask your employer to pay you again in writing by a certain date. If they fail to do so, you have the option of taking legal action. This lawsuit is one of those that cannot be lost if all the conditions described above are met.
