You may not be happy with the answer: you don’t set your own leave, your employer has to approve it. And althoughthe Labour Code says it has to take into account your legitimate interests (e.g. time with your family during the holidays), in practice it can refuse, postpone or even cancel your leave for operational reasons. For example, if a colleague falls ill or an emergency arises.
But the good news is that if your boss first approves your leave and then cancels it at the last minute, he or she must reimburse you for the costs incurred. For example, cancellation of the trip, deposit to the travel agent or transport back if you are called back from holiday. Although the law says this must be dealt with, in practice there are often arguments – which is why it’s a good idea to have everything in writing and the costs documented.
So if you are planning a summer with children, start early and insist on proper approval of the leave. And if your employer acts arbitrarily, you can defend yourself – even with the help of a lawyer.
