The Board of Directors of the Czech Bar Association discussed and approved the basic strategy for artificial intelligence, which was presented by Jana Pattynová on behalf of the Section for Artificial Intelligence and New Technologies. The document aims to update the rules for the use of AI by attorneys and sets the framework for liability, confidentiality, ethics, minimum IT standards and education.
The approved strategy focuses on several key areas: in addition to updating the rules on the use of AI in advocacy (including confidentiality, liability and ethical limits), it also aims to clarify the boundaries between legal advice and the provision of general legal information. This includes minimum IT and security standards applicable not only to large law firms but also to smaller practices, and a focus on developing AI, digital skills and cybersecurity education. At the same time, the AI and Emerging Technologies Section is already working on the first two opinions that build on this strategy.
In particular, the use of AI in court filings and liability for potential “hallucinations” of AI tools, including potential disciplinary liability, came up in the Board’s discussion. The forthcoming opinion on the use of AI should therefore define minimum standards for its use so that technological tools do not contribute to the dignity of the legal profession while promoting the quality and reliability of legal outcomes.
