Mr. Petr contacted our office after being pulled over by a police patrol. The officers claimed that he had been holding a cell phone in his hand while driving and offered to settle the violation with an on-the-spot fine.However, Petr argued that the phone had been in a holder the entire time and that he had merely touched the screen, and he refused to pay the fine.

If a person disagrees with the allegation of an offense, its legal assessment, or the amount of the fine, they are not required to consent to an on-the-spot hearing or to sign the citation. This is because signing the ticket makes it final and enforceable, and it is generally no longer possible to appeal a standard fine.

After refusing the fine, the case is typically referred to administrative proceedings. In these proceedings, the accused has the right to review the evidence, comment on it, and present their own evidence, such as dashcam footage or a passenger’s testimony. The administrative authority must prove that the offense actually occurred and that the accused committed it. However, rejecting the fine is not without risk: if the authority proves guilt, it may impose a fine at the statutory rate and also add a flat-rate fee for the proceedings. If, instead, a written order is sent by mail or to your digital mailbox, you may file an objection within eight days.
