As of 1 January 2026, lawyers will have a new obligation – they will have to enter each escrow into an electronic escrow book before receiving money. The aim is to strengthen the prevention of money laundering and abuse of solicitors’ services.
The change responds to the demands of national and international authorities for stricter control of financial flows. Previously, escrows were only entered into the EAC retrospectively – i.e. after the amount was credited to the lawyer’s account. However, it will now be necessary to report the intention to take custody in advance, which will allow for more effective supervision and early detection of suspicious transactions.
The Czech Bar Association has announced the change in advance and provides attorneys with the necessary training and methodology. The transitional period until the end of 2025 is used to test the new procedure in practice. However, from January 2026, preliminary reporting will be mandatory for all.
