Places reserved for people with disabilities are protected by law and it is an offence to stop or stand without a valid pass. Even a short stop can be treated by the authorities as a traffic offence.

According to the Road Traffic Act , the length of the stop is not decisive – if a car is stopped in a designated place and is not there legally, it is an offence. The only exception is if you are stopping to allow a person with a disabled person’s card to get in or out, or for another legal reason (e.g. an accident). If you are only getting out or waiting for a short time, it is still stopping in a prohibited place in the eyes of the law.

If you consider the fine to be unfair (e.g. it was really only a necessary stop for the transport of an authorised person), we recommend that you file a written objection to the fine in the administrative procedure. Prove that you had a legal reason for the stop – for example, by providing a witness statement or a copy of the disabled person’s ID card. Otherwise, you will have to pay the fine.
