The dispute over the new budget rules is heading to the Constitutional Court. A group of more than 70 opposition lawmakers has filed a motion to strike down part of the law that the Chamber of Deputies passed in August despite the president’s veto. The lawmakers are challenging both the content of the changes and the manner in which they were approved.
The petition was filed with the Constitutional Court on September 4, 2026. The opposition primarily criticizes the expansion of the government’s authority to manage spending limits and, in its view, the weakening of parliamentary oversight of the state’s finances. It also alleges flaws in the legislative process through which the amendment was adopted. The challenged law has already been promulgated, and most of it has taken effect.
The Constitutional Court will therefore assess whether the new budgetary rules and the manner in which they were adopted are in accordance with the constitutional order. However, the mere filing of the petition does not mean that the law is unconstitutional or that it ceases to be valid. The challenged provisions remain in effect until the Constitutional Court, if applicable, rules to repeal them.
