The amendment to the law, which tightened the conditions for early pensions and changed the method of their valorisation, remains in force. The Constitutional Court rejected a motion by a group of ANO MPs who questioned both the content of the amendment and the way it was approved.
The Constitutional Court has ruled that the amendment to the Pension Act, which is effective from October 2023, does not violate the constitutional order. The court rejected a motion by ANO MPs who argued that the law violates the rule of law and that the law on the Rules of Procedure of the Chamber of Deputies was not complied with during its approval. While the court found that there had indeed been a formal error during the vote – the debate was closed before all the speakers had taken the floor – it also stated that the error had not reached unconstitutional intensity.
At the same time, the court reiterated the unsatisfactory state of the House Rules of Procedure and called for their reform. It described the current system as unsustainable in the long term and not allowing for the effective enforcement of the legitimate will of the majority in a situation of obstruction.
