
Under a new Senate bill, the statute of limitations for murder would be eliminated. On September 30, the Senate approved its own amendment to the Criminal Code, which is intended to allow for the prosecution of murderers even decades after the crime was committed.
Currently, crimes that are not subject to a statute of limitations include, for example, genocide, crimes against humanity, and certain war crimes. However, a statute of limitations still applies to murder. Senators want to change this rule, citing in particular advances in forensic methods—such as DNA analysis—which now make it possible to solve even very old cases.
However, the change is not yet in effect. The Senate has only approved its own legislative proposal, which will now go to the government and subsequently to the Chamber of Deputies. Only the Chamber of Deputies will decide whether the proposal moves forward and in what form. In addition, other proposals addressing the lack of a statute of limitations for murder are being prepared in the Chamber of Deputies, so the final wording of the amendment may still differ.
