As of 1 July 2025, trans people in the Czech Republic will no longer have to undergo sterilisation or surgery to officially change their gender. The change comes in the wake of last year’s ruling by the Constitutional Court, which deemed the current practice unconstitutional. However, instead of a legislative change, so far there has only been a modification of the methodology by the ministries of health and interior.
The Constitutional Court has abolished the provisions that linked surgery and the impossibility of reproduction to a legal change of sex.The previous requirement for approval of surgery by a committee of the ministry and the need for castration have been abolished. The new procedure described in the Ministry of Health’s methodology is based on informed consent and a diagnosis of transsexualism made by a sexologist. The sexologist will now issue a certificate to the registry office, on the basis of which a change in the registry data can be made. The change of name or surname remains voluntary.
However, critics say the methodology alone is not enough. Without explicit legislation, trans people remain in legal limbo, which may be threatened with any change in political representation. Meanwhile, the Ministry of Justice admitted last year that the necessary amendment to the law was ready but lacked the political will to do so.
