My neighbor got a drone and often flies it over our property where we have a pool. It’s not the noise that bothers me, but the fact that it’s filming the kids. He claims he has the right to fly it because it doesn’t violate the flight altitude. Is there any way I can defend myself?

Yes, you can. Even if your neighbour claims height limits and compliance with drone regulations, he has no right to invade your privacy. Flying over your property – especially if it involves filming children by the pool – can be an infringement of your right to privacy and family life under both the Civil Code and the GDPR.

Start by asking your neighbour in writing to refrain from flying over your property and taking footage. It may help if it is a pre-action notice backed by a lawyer. If that doesn’t help, you can contact the Data Protection Authority or, preferably, file a civil lawsuit. In some cases, it may even be a misdemeanor – and a felony if the footage was distributed or used without your consent. Privacy in one’s own backyard carries substantial weight.
