Amendment to the Criminal Code: murder will be statute-barred after 30 years

The statute of limitations for criminal liability for murder under Section 140(1) and (2) of the Criminal Code has been extended from 15 to 30 years. The amendment was adopted on the basis of a parliamentary amendment which included murder among the offences listed in Article 34(1)(a) of the Criminal Code.

The reason is simple and hard to dispute: the gravity of the crime and the irreparability of its consequences. The reasoning also responds to the development of criminalistics and forensic technology – identifying perpetrators after decades is no longer science fiction, but a common phenomenon. The Czech legislation is thus approaching Germany, Italy or Switzerland; in some countries (e.g. Norway, Sweden) murder is not prosecuted at all.
