Do you receive a parcel from a courier and immediately see that it is damaged? The liability solution depends primarily on who was your contractual partner – the carrier or the seller.

If you have ordered goods from an e-shop, for example, the seller is responsible for any damage during transport until you take delivery. In this case, the courier is just a carrier who performs the transport on the basis of a contract between the seller and the carrier. If the package is damaged, you have the right to file a claim directly against the seller. The seller should deal with the situation – replace the goods, refund the money or arrange for repairs.

However, if you ordered the transport yourself (e.g. in the case of transporting your own goods), the carrier could be held directly liable for the damage incurred during transport according to the transport contract. However, it is also advisable to record the damage as soon as you receive the parcel – ideally with photographic documentation and a record of the damage.
