Debtors’ non-forfeitable amount: new calculation from January 2026

As of 1 January 2026, the method of calculating the amount to be withheld from wages will change. The government has approved a regulation that responds to the introduction of the so-called super allowance and replaces the existing normative housing costs with new parameters. The change is intended to maintain a comparable level of protected income, but has also sparked a dispute between departments.

The government regulation, prepared by the Ministry of Justice and approved on 10 December, stipulates that the non-forfeitable amount will now be calculated on the basis of the individual’s subsistence minimum, the standard rent and the flat rate for utilities. Crucially, it will be based on the values in force on 1 January of each year. The amount to be forfeited per debtor will therefore be 85% of the sum of these three components, specifically CZK 13 200 in 2026, with a quarter of this amount for each dependent. At the same time, the threshold for unlimited deductions from wages is increased to 1.9 times the above sum.

While the Ministry of Justice defends the change as a technical adjustment to maintain the realistic amount of the uncollectible minimum and reduce the administrative burden on employers, the Ministry of Labour and Social Affairs warns of its impact. In particular, it criticises the “freezing” of January values for the whole year, which will not be reflected in the planned increase in the minimum subsistence level from May.According to the ministry, this may leave a portion of borrowers’ incomes less protected for several months than would be consistent with current social parameters. The dispute is thus a reminder that even a seemingly technical change in the calculation formula can have a very concrete impact on wallets – and in foreclosures, this is doubly true.
