Government backs tightening of asylum and migration rules

On 2 April 2025, the Government of the Czech Republic expressed a favourable opinion on the draft amendment to the Asylum Act and the Act on the Residence of Foreigners submitted by a group of coalition MPs, including Prime Minister Petr Fiala and Interior Minister Vít Rakušan. The amendment aims to tighten the Czech Republic’s asylum and migration policy in response to the new EU migration pact and the planned tightening of rules in Germany.

Key points of the proposed amendment:

  • Restriction of targeted asylum applications: Foreigners who have been deported will not be able to apply for asylum, which is intended to prevent abuse of the asylum system to delay return to their country of origin.
  • Speeding up the expulsion process: linking the procedure for not granting international protection with the decision to return the foreigner to the country of origin is intended to speed up the expulsion process.
  • Stricter control of asylum seekers: Authorities will be able to determine the place of residence of asylum seekers or order them to stay in asylum facilities.
  • Restriction of social standards: Material benefits and access to the labour market may be restricted in case of problematic behaviour of asylum seekers.
  • Enhancing security screening: Police and authorities will be able to use information from migrants’ mobile phones to identify them
