Register of beneficial owners closes to the public from December

From 17 December 2025, the Register of Beneficial Owners will no longer be freely accessible to the public. The Ministry of Justice is taking this step following the decisions of European and Czech courts, which have warned of the inconsistency of the current form of the register with the right to privacy protection.

The registration of beneficial owners has been open to the general public in the Czech Republic until now. This made it possible to find out who actually controlled a particular company and served, for example, to verify business partners or as a tool of public control. However, the system has run up against EU case law – specifically a 2022 CJEU ruling that the blanket disclosure of beneficial owner data constitutes a disproportionate interference with their right to privacy.

Following this interpretation, the Czech courts have gradually ruled on this issue, which led the Ministry of Justice to decide to close the registers. As of mid-December, only selected entities, such as public authorities, banks or public procurement authorities, will have access. Journalists, lawyers or the public will only be able to obtain the data on the basis of an individual request to the relevant regional court, with the provision of the information being conditional on the demonstration of a legitimate interest.
