Monetary punishment gets the green light: courts can impose it for any offence

An amendment to the Criminal Code from January significantly expands the possibilities of imposing financial penalties. The court can now impose them for any offence – separately or in addition to other punishments. The law explicitly emphasises their importance, particularly where the offender has obtained (or tried to obtain) a financial benefit by committing a deliberate criminal act.

The change responds to both practice and statistics: the proportion of fines imposed has been rising for a long time, and in 2024 it has already exceeded 25% of convicts. The amendment goes even further – the number of daily rates will now be based on the upper limit of the prison sentence, i.e. the seriousness of the offence. This may mean very high fines (rather unusual abroad), but the logic is clear and points towards proportionality of punishment.

In addition, the funds from fines can be used to satisfy the claims of victims. Thus, property penalties are not only a repression but also a practical tool for compensation.
