Pavement incompetence does not relieve the owner of liability

This year, the Constitutional Court heard the case of a complainant who slipped on a sidewalk in 2017 and broke his ankle. In its ruling, the Constitutional Court stated that if a pedestrian suffered personal injury as a result of an uncleared, icy pavement, the liability of the road owner cannot be excluded with regard to the foreseeability of the situation.

It will no longer be possible to rely on electronic submissions sent to the court at the last minute. According to the Constitutional Court, the timeliness of an electronic submission made by e-mail must be assessed according to the moment when the submission reaches the court, not according to the moment when it is sent by the applicant.

In mid-March, we launched a special free service in the Accessible Advocate for all those affected by the COVID-19 pandemic crisis, providing one-to-one consultations on the most pressing issues. We made full use of our unique e-commerce platform-based system linking a person in a difficult situation with an advocate who is willing to provide a no-cost consultation. Almost 200 clients have used the service and 7 external lawyers have been involved, to whom we are very grateful.
